Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the websites, applications, APIs, and related services offered by SendStackr ("SendStackr," "we," "us," or "our"). By creating an account, accessing, or using the services, you agree to these Terms.

If you are using the services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.

If you do not agree, do not use the services. The formal legal entity name operating SendStackr may be updated by us from time to time and should be confirmed with counsel for your records.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the services. You may not use the services if you are barred under applicable law or if we have previously terminated your account for a material breach.

The services

SendStackr provides cloud-based software and APIs for building, automating, and operating communication and AI-assisted workflows, including integrations with third-party channels and model providers. Features may vary by plan and region.

We may modify, suspend, or discontinue parts of the services (including features, limits, or integrations) with reasonable notice where practicable. We may offer beta or experimental features that are provided "as is" and may be withdrawn without liability.

Accounts and credentials

You must provide accurate account information and keep it current. You are responsible for all activity under your account, including actions by your team members, API clients, and automation.

You must safeguard passwords, API keys, tokens, webhooks, and other credentials. You must notify us promptly at the contact below if you suspect unauthorized access or credential compromise.

License and permitted use

Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the services for your internal business purposes, and to integrate with the services using our documented interfaces.

  • Use the services only in compliance with applicable laws and regulations.
  • Process content and personal data for which you have a lawful basis and any required consents or notices.
  • Use APIs, SDKs, and webhooks only as documented and only for legitimate operational purposes.
  • Configure reasonable safeguards (access controls, rate awareness, monitoring) appropriate to your use case.

Restrictions and prohibited conduct

You may not, and may not permit others to:

  • Use the services for unlawful, fraudulent, harassing, discriminatory, or harmful purposes, or to distribute malware, spam, or deceptive content.
  • Violate intellectual property, privacy, publicity, or other rights of any person, or upload content you do not have the right to use.
  • Probe, scan, or test the vulnerability of the services or our infrastructure; breach or circumvent security or authentication; or access data or systems without authorization.
  • Interfere with or disrupt the services, other customers, or third-party networks (including denial-of-service attacks, excessive or abusive load, or resource exhaustion).
  • Reverse engineer, decompile, or disassemble the services except to the extent such restriction is prohibited by applicable law.
  • Use automated means to scrape, harvest, or extract data from the services outside our documented APIs and export tools.
  • Share, sell, or transfer accounts or credentials to evade limits, billing, enforcement, or identity requirements.
  • Use the services to build or train a competing product using our proprietary interfaces or non-public documentation, or to extract non-public training corpora from the services where not expressly permitted.
  • Misrepresent your identity, affiliation, or the origin of messages sent through the services.
  • Use the services in violation of export control, sanctions, or anti-corruption laws.

Customer content and acceptable use

You are responsible for all content, prompts, attachments, configurations, and data you submit to the services ("Customer Content"). You represent that you have the rights and authority needed for us and our subprocessors to process Customer Content as described in our Privacy Policy.

You will not use the services to send unlawful communications, to violate carrier or platform policies for messaging channels you connect, or to circumvent recipient consent or suppression requirements where they apply.

Copyright and trademark complaints

If you believe material on the services infringes your rights, send a notice with the information required by applicable law to [email protected]. We may remove or disable access to material in appropriate circumstances. Do not make false claims; you may be liable for damages under applicable law.

Third-party services

The services may integrate with third-party providers (for example, messaging channels, hosting, analytics, and AI model providers). Your use of third-party services may be subject to their separate terms and privacy policies. We are not responsible for third-party services.

Fees, taxes, and billing

Paid plans, usage limits, and billing terms are described on our pricing and checkout flows. Fees are exclusive of taxes unless stated otherwise. You are responsible for applicable taxes. Late or failed payment may result in suspension or termination of paid features.

Suspension and termination

We may suspend access immediately if we reasonably believe there is a security risk, abuse, legal obligation, or material breach. We may terminate your account for repeated breach, non-payment (where applicable), or extended inactivity as described in product documentation.

You may stop using the services at any time. Upon termination, your right to access the services ceases. We may delete or retain data as described in our Privacy Policy and applicable law. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations, indemnity, and disputes) will survive.

Security and misuse

You will cooperate with reasonable security inquiries and remedial steps. You may report suspected security vulnerabilities or incidents to us at the contact below; do not perform testing that could harm production systems or other customers without our written authorization.

We may investigate misuse, preserve records, and cooperate with law enforcement and regulators as required by law. False or malicious abuse reports are prohibited.

Intellectual property

We and our licensors own the services, software, branding, and documentation, subject to the limited license above. Feedback you provide may be used without restriction or compensation.

Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER SENDSTACKR NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SENDSTACKR FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100) IF YOU HAVE NOT HAD PAYMENT OBLIGATIONS.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

Indemnity

You will defend, indemnify, and hold harmless SendStackr and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Customer Content, (b) your use of the services in violation of these Terms or law, or (c) a dispute between you and a third party relating to your use of the services.

Dispute resolution; governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. You and SendStackr consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the services, subject to injunctive or equitable relief sought by either party in any court of competent jurisdiction.

Miscellaneous

These Terms constitute the entire agreement between you and SendStackr regarding the services and supersede prior understandings on the subject. If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

You must comply with applicable export and sanctions laws. The services may not be used in embargoed jurisdictions or by prohibited parties.

What happens after you book a demo — and how fast we move.

Typical time from your first meeting to a launch-ready, usable setup: up to 5 hours.

  1. Book your discovery call using the client meeting link (Calendly).
  2. Share context for your AI agent (for example FAQs and policies you provide).
  3. Sign the proposal: $5 setup fee plus the plan you choose; an invoice is generated.
  4. We create your workflow, project, and user account.
  5. You provide the WhatsApp number that will be used as the agent channel.
  6. We test that the agent matches your context (RAG).
  7. We schedule a second meeting to demo the live agent with you.
  8. We hand off your account with sign-in credentials.
